Terms of Service & Conditions of Sale

Please review these Terms carefully before browsing, ordering, or participating in InFuture (“InFuture,” “we,” “us,” or “our”). By placing an order on infuture.global or utilizing our digital creator tools, you agree to be bound by all terms, conditions, and policies set forth below.

Final Sale Policy

All sales final. Returns only for verified manufacturing defects reported within 7 days.

Capped Liability

Liability strictly limited to the purchase price of the product or $50 CAD maximum.

Calgary Forum

All legal proceedings subject exclusively to the courts of Calgary, Alberta, Canada.

1. Acceptance & Eligibility

These Terms of Service (“Terms”) constitute a legally binding agreement between you and InFuture Inc., a Canadian corporation headquartered in Calgary, Alberta. By accessing or using our websites, purchasing our physical goods, or submitting content to our platform, you confirm that you have reached the age of majority in your province, state, or jurisdiction of residence, and possess the legal capacity to enter into binding agreements.

If you do not agree to these Terms in their entirety, you must discontinue use of our services immediately and refrain from completing any purchases.

2. Products, Variations & Blind Box Disclaimers

InFuture curates and produces cultural merchandise, collectibles, art cards, prints, postcards, and community editions.

Handcrafted & Artistic VariationsDue to the artisanal and custom nature of our products, subtle variations in paper grain, ink pigmentation, edge finishing, and metallic foil stamping are characteristic of limited-edition physical production and shall not be classified as defects or non-conformities.
Blind Box & Mystery Collectibles PolicyProducts explicitly designated as “Blind Boxes,” “Mystery Packs,” or randomized editions are sealed and distributed at random. By purchasing a blind box product, you acknowledge and agree that the specific edition, variant, character, or rarity received cannot be predicted or chosen, and duplicates may occur when purchasing multiple units.

3. Pricing, Currency & Canadian Taxes

All prices displayed on InFuture are denominated in Canadian Dollars (CAD) unless explicitly designated otherwise. InFuture reserves the right to correct pricing errors, update prices without prior notice, and cancel or reject orders placed at incorrect or misprinted prices.

Applicable Canadian federal and provincial consumption taxes (including GST, HST, and provincial sales taxes such as BC PST, SK PST, MB RST, or QC QST) are calculated at checkout based on the delivery destination. Pre-tax order subtotals of $75.00 CAD or greater qualify for free standard Canada-wide parcel shipping.

4. Fulfillment, Shipping & Risk of Loss

Delivery Address Accuracy: You are solely responsible for providing complete, accurate, and deliverable shipping information. InFuture is not liable for delayed, misrouted, or returned packages resulting from incomplete street numbers, incorrect postal codes, or unmonitored institutional/dormitory mailrooms.

Transfer of Title & Risk of Loss: All purchases of physical goods are made pursuant to a shipment contract. Title to the items and risk of loss pass to you upon our tender of the package to the commercial freight carrier (such as Canada Post, Stallion Express, Chit Chats, or their courier partners).

Free Calgary Studio Pickup: Customers choosing local pickup agree to collect their packaged orders at our designated Calgary studio during posted operating hours or pre-arranged appointments. Orders remaining uncollected after ninety (90) calendar days from notification may be recycled or restocked without refund.

5. Return, Refund & Defect Policy (Final Sale)

Conspicuous Legal Notice: All Sales Are Final

Pursuant to the Alberta Consumer Protection Act and Canadian commercial law, InFuture Inc. operates under a strict Final Sale policy. Due to the limited-edition, collectible, and custom-manufactured nature of our goods (including but not limited to blind boxes, art prints, postcards, stickers, apparel, and consumable teas), we do not accept cancellations, returns, refunds, or exchanges for change of mind, buyer’s remorse, or mistaken orders once placed.

A. Blind Box & Sealed Merchandise Exclusions

Sealed blind boxes, mystery bags, and foil-wrapped collector goods cannot be exchanged or refunded once unsealed, opened, or handled under any circumstances, including dissatisfaction with the randomized character variant received.

B. Limited Exception: Verified Manufacturing Defects & Transit Damage

If a product arrives with a severe manufacturing defect (e.g., structural failure, missing essential components, misprinted factory defects) or was crushed/broken during commercial transit, you must notify us within seven (7) calendar days of the verified carrier delivery timestamp:

  • Send an email to info@infuture.global containing your Order Confirmation Number.
  • Provide clear, unedited photographic or video evidence demonstrating the defect, the outer shipping container, and the packing slip.
  • For blind boxes, unboxing video evidence documenting the initial break of the factory foil seal is required to verify that the defect was present upon arrival.

C. Sole Discretionary Remedy

Upon verification of a valid defect or transit breakage, InFuture reserves the right to remedy the issue, at our sole discretion, by: (i) providing a direct replacement item or component (subject to inventory availability), (ii) issuing store credit in Canadian Dollars, or (iii) issuing a refund to the original payment method. Normal wear and tear, cosmetic micro-scratches, slight packaging creasing during shipping, and accidental damage are strictly excluded.

6. Creator Community & Artist Platform Terms

InFuture operates an open and curated creative platform designed to allow independent artists, designers, and students to publish concept ideas, exhibit designs, and participate in collaborative merchandise drops.

Artist Ownership of Original IP

Artists retain all underlying intellectual property rights and copyrights in the original artwork, concepts, and sketches they author and upload to InFuture.

Platform License to InFuture

By submitting, posting, or exhibiting content, designs, or ideas on InFuture, you grant InFuture Inc. a non-exclusive, worldwide, royalty-free, transferable license (with right to sublicense) to host, store, digitize, reproduce, publicly display, format, and promote your submission across our digital websites, marketing channels, and physical pop-up exhibitions.

Creator Representations & Warranties

You represent and warrant that: (i) you are the sole creator and copyright owner of the submitted idea/work or hold all necessary legal authorizations, and (ii) your work does not infringe upon the trademarks, copyrights, publicity rights, or proprietary rights of any third party (including universities, pop culture franchises, or corporate brands).

Canadian Notice-and-Notice & Takedowns

InFuture adheres to the Notice-and-Notice regime of the Canadian Copyright Act. We reserve the immediate right to remove, disable, or suspend any artist submission, idea, or merchandise listing alleged to infringe third-party intellectual property, without prior notice or liability.

7. Intellectual Property & Brand Assets

All software code, visual styling, typography arrangements, graphics, trademarks, logos, audio-visual works, and brand identifiers associated with InFuture (including “InFuture,” “The Things That Remember Us,” and our domain infuture.global) are the exclusive property of InFuture Inc. or our licensors and are protected under Canadian and international copyright and trademark laws.

8. Disclaimer of Warranties (“As Is”)

To the maximum extent permitted under applicable law, InFuture’s services, websites, digital creator platform, and physical products are provided on an “as is” and “as available” basis, without warranties, conditions, or representations of any kind, whether express, implied, statutory, or collateral, including without limitation implied warranties of merchantability, fitness for a particular purpose, durability, quiet enjoyment, and non-infringement.

9. Limitation of Liability & Indemnity

Comprehensive Corporate Liability Shield

In no event shall InFuture Inc., its founders, directors, officers, employees, affiliates, agents, or contractors be liable for any indirect, incidental, punitive, special, exemplary, or consequential damages (including loss of profits, loss of data, loss of goodwill, business interruption, or personal emotional distress) arising out of or in connection with these Terms, your use of or inability to use our services, or any merchandise purchased, whether based on contract, tort (including negligence), strict liability, or otherwise.

Total Aggregate Liability Cap: In no event shall the total aggregate liability of InFuture Inc. for all claims, damages, and causes of action exceed the greater of: (a) the actual amount paid by you to InFuture for the specific order giving rise to the claim, or (b) fifty Canadian Dollars ($50.00 CAD).

Indemnification: You agree to defend, indemnify, and hold harmless InFuture Inc. and its directors, officers, and employees from and against any third-party claims, liabilities, losses, damages, fines, and legal expenses (including reasonable legal fees) resulting from your breach of these Terms, your violation of applicable laws, or your infringement of third-party rights.

10. Governing Law & Dispute Forum

These Terms, all transactions conducted through our website, and any disputes arising between you and InFuture Inc. shall be governed by, construed, and enforced in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without giving effect to any principles of conflict of laws.

You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of the Province of Alberta, with venue sitting in the Judicial District of Calgary, to resolve any dispute, controversy, or claim arising out of these Terms or your dealings with InFuture Inc.

11. Changes to Terms & Legal Notices

We reserve the right to revise or update these Terms at any time by posting the revised version with an updated effective date. Your continued use of our services following any posted changes constitutes your binding acceptance of the revised Terms.
